Appellant and the 1st respondent were candidates in Ugirike/Okwu/Eziama Councillor Ward election in which the 1st respondent was declared winner.

Appellant dissatisfied with the declaration filed a petition at the Election Tribunal claiming that he scored a greater number of votes in the election and ought to be declared winner.

The tribunal dismissed the petition.

Appellant dissatisfied appealed.
